Terms of service

These terms govern the use of Domaining, the service at domaining.io. By creating an account you accept them.

1. Definitions

  • Service: the Domaining workspace at domaining.io and everything it includes
  • Member: a person or company with a Domaining account
  • Plan: a paid subscription (Starter, Pro, Portfolio or Enterprise) with the limits shown on the pricing page
  • Backorder: a member's request to register an expiring name when it becomes available
  • Member auction: a private auction between members who backordered the same name
  • Listing: a name a member offers for sale on the marketplace
  • Buyer: anyone who buys a listed name, with or without an account

2. Accounts

You create an account with your email address and confirm it with a one-time code. You keep access to your email secure and are responsible for actions taken from your account and by the seats you add. An account is for one person or one company. You must be at least 18 years old and able to enter into a contract.

3. Plans and billing

  • Plans are subscriptions billed monthly or yearly in advance, as shown on the pricing page
  • A plan renews automatically at the end of each period until you cancel
  • You can cancel at any time, and your plan stays active until the end of the paid period
  • Limits (backorders, rules, appraisals, listings, parking, API requests, seats) renew with each billing period and do not carry over
  • Moving to a higher plan applies right away; moving to a lower plan applies from the next period
  • There is no free plan. The scanner, rule tester and value estimator on the public site are a one-time trial without an account
  • Enterprise terms, limits and invoicing are agreed in writing

4. What you pay for a name

Your plan covers the service. When a backorder succeeds you pay the domain's registration fee, the price of the name itself. The registration fee depends on the extension and is shown on the backorder before you place it. It is charged only when the name is registered to your account. When several members backorder the same name, it goes to a private auction between them and the winner pays the closing bid. The price of a name bought on the marketplace is agreed between buyer and seller. Registration fees, closing bids and marketplace prices are the price of the name and are settled through escrow or at registration. They are not fees for the service.

5. Backorders and no guarantee of result

A backorder is an attempt to register a name when it becomes available. The result depends on factors outside our control, including renewal by the current owner during grace or redemption, registry rules and registration by other parties. We do not guarantee that any backorder succeeds. A backorder that does not succeed costs nothing beyond your plan. Drop dates and statuses shown in the service are estimates based on each name's expiry cycle.

6. Member auctions

Only members who held a backorder on a name before its drop can bid in its member auction. Bids are binding. The highest bid when the auction closes wins, and the winner pays the closing bid. If the winner does not pay within the time shown in the auction, the name may be offered to the next highest bidder and the non-paying member may lose access to auctions.

7. Marketplace, escrow, parking and brokerage

  • Sellers may list only names they own or are authorised to sell
  • Every marketplace sale settles through escrow: the buyer pays into escrow, the seller transfers the name, and the payment is released after the transfer is confirmed
  • If the transfer does not happen within the time shown in the transaction, the buyer's payment is returned
  • We do not charge a commission on marketplace sales made through a member's plan
  • Parked names show a for-sale page with the price or an offer form
  • Brokerage campaigns and buyer matching introduce buyers and sellers. The decision to sell and the price stay with the seller

8. Value scores and appraisals

Value scores, value bands and appraisals are estimates produced by a published scoring method. They are not offers, guarantees of price or financial advice.

9. Acceptable use

You may not use the service to register or sell names that infringe trademarks or other rights, to send spam, to scrape the service beyond your plan's API limits, to interfere with other members' auctions or to misrepresent a name you sell. We may suspend an account that breaks these rules.

10. Your data

Your watchlists, rules and backorders are private to your account. Personal data is handled as described in the privacy policy.

11. Liability

We provide the service with care, but we are not liable for the outcome of drops, for decisions of registries and registrars, or for the value you get from a name. To the extent the law allows, our liability for any claim is limited to the plan fees you paid in the 12 months before the claim. Nothing in these terms limits rights that consumer law gives you and that cannot be excluded.

12. Ending your account

You can close your account at any time by writing to [email protected]. Names registered to your account stay yours. Open escrow transactions and member auctions you joined are completed under these terms.

13. Changes to these terms

We may update these terms. We tell members about material changes by email before they apply. If you do not accept a change, you can cancel before it takes effect.
